Life Insurance Co. of North America accused of wrongfully terminating disability benefits

MIAMI – A man alleges the insurer of benefits under his Global Brass & Copper Inc. Group Life Insurance Policy wrongfully terminated his disability benefits.

Randall Oldham filed a complaint on Feb. 28 in the U.S. District Court for the Southern District of Florida against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2014, he became physically disabled and was initially approved and paid disability benefits until his claim was terminated on 2015. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly failed to timely review and respond to his appeal and failed to provide benefits when it knew the plaintiff was entitled to them.

The plaintiff seeks payment of benefits due to the plaintiff, reinstatement, all legal fees, interest, and any other relief as this court deems just. He is represented by Cesar Gavidia and Gregory Michael Dell of Attorneys Dell and Schaefer, Chartered in Hollywood.
