US Postal Solutions alleged to have misclassified employees

ORLANDO – A mail delivery management company in Orlando is accused of misclassifying its employees as independent contractors.

Nicole Caballero filed a complaint on behalf of herself and all others similarly situated on Feb. 23 in the U.S. District Court for the Middle District of Florida, Orlando Division against US Postal Solutions Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she worked for the defendant from January 2015 to September 2016 as a mailroom manager. The plaintiff holds US Postal Solutions Inc. responsible because the defendant allegedly misclassified plaintiff as an independent contractor and did not pay her at the correct rate for overtime work at a rate of time-and-one-half.

The plaintiffs request a trial by jury and seek judgment against defendant, damages, unpaid overtime wages, costs, attorney's fees, and further relief as the court deems just. She is represented by Brandon J. Hill of Wenzel Fenton Cabassa PA in Tampa.
