Woman alleges Duke Energy Florida keeps contacting her to reach another party

Phone 06

OCALA – A Marion County woman alleges an energy company has harassed her with calls in its attempt to reach an unknown person.

Serene Williams filed a complaint on Feb. 23 in the U.S. District Court for the Middle District of Florida, Ocala Division against Duke Energy Florida LLC alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that beginning in 2013, the defendant contacted her in its attempt to collect on an alleged debt from an unknown individual. The plaintiff holds Duke Energy Florida LLC responsible because the defendant allegedly called plaintiff with such frequency meant to abuse or harass, unlawfully utilized an automatic dialer and automated voice, and contacted plaintiff without prior express consent.

The plaintiff requests a trial by jury and seeks judgment against defendant; statutory, punitive, actual and treble damages; enjoinder from further violations, and other relief the court may deem just. She is represented by Jared M. Lee of Morgan & Morgan, Tampa PA in Orlando.
