Woman alleges Florida Blue unlawfully denied treatment reimbursement

LAKE CITY – A woman is seeking declaration that a dental treatment should be covered by her insurance plan.

Brooke Hand filed a complaint on Feb. 23 in the Columbia County Circuit Court against Blue Cross and Blue Shield of Florida Inc., doing business as Florida Blue, citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that on July 19, 2016, she suffered damages as a result of the denial of defendants to cover for the necessary medical treatment of her congenital deformity, which developed into temporomandibular joint dysfunction. The suit states that the defendant has denied reimbursement on the grounds that the treatment is excluded from the plaintiff's plan, but the plaintiff alleges that the treatments are covered.

The plaintiff requests a trial by jury and seeks judgment against defendants, declaration of her right to reimbursement, costs of action, attorney's fees, and further relief as the court deems necessary. She is represented by Stephen A. Smith of The Demas Law Firm PA in Lake City.
