Motivational Coaches of America Inc. alleged to have not paid appropriate rate for overtime work

MIAMI – A man alleges he was misclassified as an independent contractor and not properly compensated for overtime work.

Eric Lopez filed a complaint on Feb. 27 in the U.S. District Court for the Southern District of Florida against Motivational Coaches of America Inc., formerly known as The Non-Violence Project USA Inc. and doing business as NVpusa Healthcare; Avael Julio; Paul Rendulic; and Ronald Celiz citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week for the defendants. The plaintiff holds the defendants responsible because the defendants allegedly failed to pay the plaintiff any overtime wages at rate of time-and-one-half.

The plaintiff requests a trial by jury and seeks damages, liquidated damages, interest, all legal fees and any other relief as this court deems just. He is represented by Chad Levy of Law Offices of Levy & Levy PA in Sunrise.
