Installer alleges he was terminated over overtime complaints by Kelly Insulation

MIAMI – A Broward County man alleges his former employer did not pay for all of the overtime hours he worked as an insulation installer.

Christopher Griffin filed a complaint on Feb. 28 in the U.S. District Court for the Southern District of Florida against Kelly Insulation Inc. and Leonard AJR Olivier citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between July 2014 and March 2017, he worked for more than 40 hours per week. The plaintiff holds Kelly Insulation Inc. and Olivieri responsible because the defendants allegedly failed to pay the plaintiff any overtime premiums at a rate of time-and-one-half for working more than 40 hours per week. He alleges he was terminated in retaliation for complaining about the practice.

The plaintiff requests a trial by jury and seeks lost wages, liquidated damages, interest, all legal fees and any other relief as the court deems just. He is represented by Rose H. Robbins J.D. of Law Office of Rose H. Robbins J.D. in Boca Raton.
