MIAMI – A Broward County bakery is alleged to have not paid a rate of time-and-one-half for overtime work to a former employee.
Kalish filed a complaint on behalf of all others similarly situated on
Feb. 27 in the U.S. District Court for the Southern District of Florida
Chocolada Bakery & Cafe Inc. and Theodara Dayan
citing the Fair Labor Standards Act.
According to the complaint,
the plaintiff worked for the defendants as a cashier and counter worker
from February to July 2016. The plaintiff holds Chocolada Bakery &
Cafe Inc. and Dayan responsible because the defendants allegedly failed
to pay the plaintiff any overtime premium for hours worked that exceeded
40 hours per week.
The plaintiff requests a trial by jury and
seeks double damages, all legal fees, all overtime wages still owing,
interest, and any other relief as the court deems just. She is
