Former cashier claims Chocolada Bakery & Cafe Inc. owes her unpaid overtime wages

MIAMI – A Broward County bakery is alleged to have not paid a rate of time-and-one-half for overtime work to a former employee.

Nicole Kalish filed a complaint on behalf of all others similarly situated on Feb. 27 in the U.S. District Court for the Southern District of Florida against Chocolada Bakery & Cafe Inc. and Theodara Dayan citing the Fair Labor Standards Act.

According to the complaint, the plaintiff worked for the defendants as a cashier and counter worker from February to July 2016. The plaintiff holds Chocolada Bakery & Cafe Inc. and Dayan responsible because the defendants allegedly failed to pay the plaintiff any overtime premium for hours worked that exceeded 40 hours per week.

The plaintiff requests a trial by jury and seeks double damages, all legal fees, all overtime wages still owing, interest, and any other relief as the court deems just. She is represented by James Loren of Goldberg & Loren PA in Plantation.
