Consumer files suit against Select Portfolio Servicing Inc. over amounts on payoff statement

FORT LAUDERDALE – A Broward County woman alleges that a loan servicer charged her amounts that were too high.

Maria Edwards-Angeloni filed a complaint on Feb. 15 in the U.S. District Court for the Southern District of Florida against Select Portfolio Servicing Inc. alleging violation of the Real Estate Settlement Procedures Act.

According to the complaint, the plaintiff alleges that on Oct. 18, 2016, she received a payoff statement from the defendant charging her for an escrow/impound advance balance of $42,042.70 and loan level advance balance of $7,826.09. She alleges the statement provided no explanation or reason for assessing those charges on plaintiff's account.

The plaintiff holds Select Portfolio Servicing Inc. responsible because the defendant allegedly failed to adequately respond to a notice of error sent by plaintiff's counsel, and failed to conduct a reasonable investigation into plaintiff’s contention that the charges were too high.

The plaintiff requests a trial by jury and seeks judgment in her favor, monetary damages, attorney's fees and litigation costs. She is represented by Jeffrey N. Golant of Law Offices of Jeffrey N. Golant PA in Coral Springs.
