MIAMI — A North Carolina mother is suing Carnival Corporation, a cruise ship operator, citing alleged negligence due to a sexual assault against her minor daughter.

A woman identified as J.B., as natural mother and legal guardian of R.P., a minor, filed a complaint on Feb. 20 in the U.S. District Court for the Southern District of Florida Miami Division against Carnival alleging that it breached its duty to provide a safe environment for its guests, specifically minors.

According to the complaint, the plaintiff alleges that on Feb. 25, 2016, she and her minor daughter were passengers aboard defendant's cruise ship, Carnival Fantasy, when her daughter was approached by a man who pulled into a secluded area, kissing and touching her inappropriately until she fought herself loose and ran away. Plaintiff's daughter suffered physical pain, mental anguish and incurred medical expenses. The plaintiff holds Carnival responsible because it allegedly failed to provide adequate supervision and/or security for minor passengers aboard its cruise ships and failed to warn minors of the potential of being sexually assaulted or raped aboard the cruise ship.

The plaintiff requests a trial by jury and seeks compensatory damages, as well as pre- and post-judgment interest and costs in bringing the action. She is represented by Judd G. Rosen of Goldberg & Rosen PA in Miami.
