WEST PALM BEACH – A certified nurse's assistant for a Palm Beach County employer has filed a class action over unpaid overtime allegations.
Kimberly Anspach filed a complaint on behalf of all others similarly situated on Feb. 15 in the U.S. District Court for the Southern District of Florida, West Palm Beach Division against Family Private Care Inc. citing the Florida Minimum Wage Act and the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that she worked as a nurse's assistant for more than 40 hours per week but was not paid any overtime compensation. The plaintiff holds Family Private Care Inc. responsible because the defendant allegedly failed to pay minimum wage to the plaintiff or overtime compensation at a rate of one-and-one-half of her regular pay.
The plaintiff requests a trial by jury and seeks damages, unpaid overtime wages, lost benefits, liquidated damages, all legal fees, interest, and any other relief as the court deems just.
