Jacksonville man says debt collector called repeatedly despite requests to stop

JACKSONVILLE — A Jacksonville resident is suing a debt collector, citing alleged violation of the Telephone Consumer Protection Act (TCPA).

Jerry Alston filed a complaint on Jan. 25 in the U.S. District Court for the Middle District of Florida against Simple RTO LLC, d/b/a Simple Finance, alleging that the debt collector communicated with him through unlawful means.

According to the complaint, Alston alleges that, in September 2016 he suffered from abuse and harassment, including stress, anxiety, embarrassment, distress and aggravation because of the defendant's barrage of calls using an autodialer and prerecorded voice to collect an alleged debt. The calls continued despite his repeated requests for the calls to stop. Alston holds Simple Finance responsible because the company allegedly called him with such frequency meant to abuse or harass, contacted him without prior express consent and unlawfully utilized an automatic dialer and automated voice.

Alston requests a trial by jury and seeks judgment against defendant, statutory, punitive, actual and treble damages, enjoinder from further violations, costs, attorney's fees and other relief the court may deem just. He is represented by Octavio Gomez of Morgan & Morgan PA in Tampa.
