Pillar to Post accuses Pillar Home Inspections of trademark infringement

JACKSONVILLE – A Canadian home inspection company with an office in Tampa alleges a Jacksonville company is infringing its trademark.

Pillar to Post Inc. filed a complaint on Jan. 27 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against Pillar Home Inspections LLC and Jordan H. Berman alleging trademark infringement.

According to the complaint, the plaintiff alleges that it has suffered a loss of profits, reputation and goodwill as a result of defendants' use of a confusingly similar trade name and logo for their own home inspection business, in direct competition with plaintiff. The plaintiff holds Pillar Home Inspections LLC and Berman responsible because the defendants allegedly caused injury to plaintiff and its franchisees through the loss of its business reputation and revenue, and refused to respond to several demands from plaintiff's legal counsel to cease and desist the imported infringement.

The plaintiff requests a trial by jury and seeks judgment against defendants, declaratory relief, remove and destroy all infringing materials, monetary damages, tripled damages for willful acts, attorneys' fees, costs of action, interest, and other relief as the court deems just. They are represented by Paul D. Watson and Natalie Thomas of Sivyer Barlow & Watson PA in Tampa.
