MIAMI — A former employee of Zubi Supermarket has filed a class-action lawsuit against the store and its owner, citing alleged unpaid wages and violation of workers' compensation acts.
Mario A. Martinez filed a complaint on behalf of all others similarly situated on Jan. 31, in the U.S. District Court for the Southern District of Florida against
Ernesli Corporation, d/b/a Zubi Supermarket, and Ernesto Perez, alleging that they failed to pay fair wages to the plaintiff for his work.
According to the complaint, the plaintiff alleges that he worked more than 40 hours per week without being paid any overtime compensation. The plaintiff holds the defendants responsible because they allegedly failed to pay the plaintiff any overtime for working more than 40 hours.
The plaintiff requests a trial by jury and seeks double damages, all overtime wages still owed, all legal fees and any other relief as this court deems just. He is represented by J.H. Zidell of J.H. Zidell, P.A. in Miami Beach.
