Passenger accused Carnival Corp. of negligence over allegedly refusing medical assistance

MIAMI – A cruise ship passenger alleges he was injured because he was not provided proper medical care.

Samir Gharfeh filed a complaint on Feb. 8 in the U.S. District Court for the Southern District of Florida, Miami Division against Carnival Corp., doing business as Carnival Cruise Line, and Catalina Carvajal, M.D. alleging negligence.

According to the complaint, the plaintiff alleges that in February 2016, he experienced lower abdominal pain while on a cruise with his family on the Carnival Freedom. His son, who is a doctor and was traveling with him, contacted the defendant's medical desk and asked for oral antibiotics to treat the plaintiff's diverticulitis. The plaintiff holds Carnival Corp. and Carvajal responsible because the defendants allegedly kept on refusing the request for plaintiff's antibiotics and proper medical assistance despite having knowledge of the urgency of the request.

The plaintiff seeks damages, all legal fees, interest, and any other relief as the court deems just. He is represented by John H. Hickey of Hickey Law Firm, P.A. in Miami.
