Nurse claims Lincoln National Life Insurance unlawfully denied disability benefits

TAMPA – A licensed practical nurse claims she claim for long-term disability benefits was wrongfully denied.

Lorraine Ousley filed a complaint on Feb. 1 in the Tampa Division of the Middle District of Florida against The Lincoln National Life Insurance Co. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she became disabled due to having a heart disorder and applied for disability benefits but was denied in 2015. The plaintiff holds The Lincoln National Life Insurance Co. responsible because the defendant allegedly refused to pay the plaintiff for disability benefits based on its claim that she does not satisfy the definition of total disability according to the policy.

The plaintiff seeks declare that the plaintiff is entitled to long-term disability benefits, benefits not paid for a total of $42,224 plus interest, all legal fees and any other relief as the court deems just. She is represented by John V. Tucker and Amy Ray of Tucker & Ludin PA in St. Petersburg.
