Consumer alleges Credit Protection Association unlawfully called numerous times to reach third party

JACKSONVILLE – An individual claims a debt collector called him more than 130 times in an attempt to collect an alleged debt owed by his wife.

Scott Fortier filed a complaint on Feb. 3 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against Credit Protection Association LP citing the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that in February 2015, he suffered damages from receiving several collection calls on his cellphone from the defendant attempting to reach his wife. The plaintiff holds Credit Protection Association L.P. responsible because the defendant allegedly kept on calling the plaintiff despite his request to stop calling and for its alleged use of an automatic dialing system.

The plaintiff requests a trial by jury and seeks actual and statutory damages, enjoin the defendant, all legal fees and any other relief as this court deems just. He is represented by Todd M. Davis of Davis Law Firm in Jacksonville.
