MRC Express Inc. accused of not paying overtime rate to employee

MIAMI – A Dade County man alleges he was not paid time-and-one-half for overtime work.

Delfin Eduardo Sosa filed a complaint on behalf of all others similarly situated on Feb. 2 in the U.S. District Court for the Southern District of Florida against MRC Express Inc. citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked an average of 60 hours a week without being paid overtime compensation. The plaintiff holds MRC Express Inc. responsible because the defendant allegedly failed to pay the plaintiff any overtime premiums at a rate of time-and-one-half for working more than 40 hours per week.

The plaintiff requests a trial by jury and seeks double damages, overtime wages still owing, all legal fees plus interest, and any other relief as the court deems just. He is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
