Estate representative alleges negligence of USPS employee lead to motorcyclist's death

MIAMI – A personal representative of the estate of a Miami-Dade County man alleges he was killed in an accident because the negligence of a federal employee.

Xenia Rolon, as personal representative of the estate of Cesar David Castro, filed a complaint on Feb. 1 in the U.S. District Court for the Southern District of Florida, Miami Division against United States of America alleging wrongful death and negligence.

According to the complaint, the plaintiff alleges that on March 22, 2015, Cesar David Castro collided with the rear end of a United States Postal Service vehicle while riding his motorcycle, resulting in injuries that lead to his death. The plaintiff holds United States of America responsible because the defendant's employee allegedly had abruptly stopped to make a left turn and carelessly operated the vehicle.

The plaintiff seeks damages, interest, all legal fees and any other relief as this court deems just. She is represented by Scott T. McCullough of McCullough & Leboff PA in Davie.
