Transport Workers Union of America AFL-CIO seeks to compel arbitration in Centerra Group dispute

ORLANDO – A labor union representing workers at Cape Canaveral Air Force Station alleges Centerra has refused to proceed to arbitration.

Transport Workers Union of America AFL-CIO filed a complaint on Jan. 23, in the U.S. District Court for the Middle District of Florida Orlando Division against Centerra Group LLC seeking a motion to compel arbitration.

According to the complaint, the plaintiffs allege that on Oct. 1, 2016, the defendant implemented a new work schedule requiring plaintiff's bargaining unit members to work 48 hours on-duty, 48 hours off-duty instead of the previous 24 hours on-duty followed by 48 hours off-duty. The suit states the plaintiff filed grievance regarding the defendant's changes of the unit member's hours of work. The plaintiffs holds Centerra Group LLC responsible because the defendant allegedly refused to process the grievance and refused to proceed to arbitration.

The plaintiffs request a trial by jury and seek requests that the court compel Centerra to submit the grievance for arbitration pursuant to the collective bargaining agreement, and award plaintiff costs and all other relief to which it may be found entitled. It is represented by Richard Siwica and Eric Lindstrom of Egan, Lev and Siwica PA in Orlando.
