Former JMN Deli Corp. employee alleges wage law violations

MIAMI – A Miami resident claims she worked at least 15 overtime hours a week and was not paid for that time.

Dilcia G. Jimenez filed a complaint on behalf of other similarly situated individuals on Jan. 26 in the U.S. District Court for the Southern District of Florida, Miami Division against JMN Deli Corp. and Jose M. Nunez citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she worked more than 40 hours as a cook and kitchen help but was not paid minimum and overtime wages during her employment from 2009 to 2016. The plaintiff holds JMN Deli Corp. and Jose M. Nunez responsible because the defendants allegedly failed to provide an accurate wage statement to the plaintiff and instead paid her weekly on a cash basis.

The plaintiff requests a trial by jury and seeks actual damages, double damages/liquidated damages, all legal fees and any other relief as the court deems just. She is represented by Zandro E. Palma of Zandro E. Palma PA in Miami.
