Motorist alleges State Farm Mutual Automobile Insurance denied coverage

SANFORD – A Seminole County resident alleges his insurer wrongfully failed to pay underinsured motorist coverage.

Derek Flynn filed a complaint on Jan. 6 in the 18th Judicial Circuit Court of Florida - Seminole County against State Farm Mutual Automobile Insurance Co. alleging that the insurer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on March 24, 2015, he was operating a motor vehicle traveling westbound on Interstate 4 in Altamonte Springs when a vehicle driven by an underinsured driver, Nicole Castro, rear-ended plaintiff's motor vehicle. The suit states the defendant issued a policy of insurance to plaintiff, which was in full force and effect on the date of the accident. The plaintiff holds State Farm Mutual Automobile Insurance Co. responsible because the defendant allegedly denied that coverage exists and/or refused to pay plaintiff for the full value of the claim.

The plaintiff requests a trial by jury and seeks judgment for damages against defendant, and other such relief deemed proper by the court. He is represented by W. Clay Mitchell of Morgan & Morgan PA in Orlando.
