MIAMI – A former employee of a patient transportation service in Miami-Dade County alleges he was misclassified as an independent contractor.

Frank Bombino filed a complaint on behalf of other similarly situated individuals on Jan. 4 in the U.S. District Court for the Southern District of Florida, Miami Division against Sunshine Transportation Service Inc. and Yasiel Cabre citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked 65 hours per week without being paid any overtime compensation and was not reimbursed for gasoline and car expenses per week. The suit states he was employed from June 2015 to September 2016 and used his own vehicle to perform his duties. The plaintiff holds Sunshine Transportation Service Inc. and Cabre responsible because the defendants allegedly allowed the plaintiff to work more than 40 hours per week but failed to pay him any overtime premiums at a rate of time-and-one-half and did not pay him a minimum wage.

The plaintiff requests a trial by jury and seeks actual damages, unpaid minimum wages, interest, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by Zandro E. Palma of Zandro E. Palma PA in Miami.
