Consumer files suit over alleged injuries from Takata airbag

MIAMI – A Miami-Dade County man alleges he was injured by a Takata Corp. airbag in his Honda.

Evelio Ruiz filed a complaint on Jan. 12 in the U.S. District Court for the Southern District of Florida against Takata Corp., TK Holdings Inc., Honda Motor Co. LTD, American Honda Motor Co. Inc., Honda of America Mfg. Inc., Honda R&D Co. LTD alleging negligence and other counts.

According to the complaint, the plaintiff alleges that on March 13, 2015, he suffered several lacerations to his neck when the airbag system of his 2002 Honda Accord deployed with excessive force because of a collision. He alleges he did not receive a recall notice on the airbag until a month after the incident.

The plaintiff holds Takata Corp., TK Holdings Inc., Honda Motor Co. LTD, American Honda Motor Co. Inc., Honda of America Mfg. Inc., Honda R&D Co. LTD responsible because the defendants allegedly used defective components for the propulsion of their airbag systems.

The plaintiff requests a trial by jury and seeks compensatory damages, punitive damages, interest, all legal fees and any other relief as the court deems just. He is represented by Peter Prieto, Aaron S. Podhurst, John Gravante, Matthew P. Weinshall and Alissa Del Riego of Podhurst Orseck, P.A. in Miami.
