ORLANDO – Homeowners have filed suit against their insurer over claims it wrongfully refused to provide coverage for weather damage to their home.
Sanjana Sarna and Rajput Sumeet filed a complaint on Dec. 29 in the 9th Judicial Circuit Court of Florida - Orange County against Southern Fidelity Property and Casualty alleging violation of a contract.
According to the complaint, the plaintiffs allege that on May 4, 2016, their Windermere residence suffered damages due to a severe weather event and notified the defendant. However, the defendant refused to pay full coverage of insurance claim, specifically the roof replacement, despite policy being in full force and effect.
The plaintiffs hold Southern Fidelity Property and Casualty responsible because the defendant allegedly denied coverage for the roof, refused to pay for the roof replacement, and failed to provide plaintiff with a reasonable proof to establish non-payment of full insurance claim.
The plaintiffs request a trial by jury and seek judgment against defendant for property damages, personal property and/or loss of use, interest, costs, and attorneys' fees. They are represented by Steven M. Johnson of Johnson and Williams PA in Orlando.
