Woman alleges she was pushed over handrail, broke neck at Vain Nightclub

ORLANDO – A visiting professor at the University of Florida from Turkey alleges she was pushed over a handrail on the staircase at a nightclub and broke her neck.

Oznur Olmez filed a complaint on Dec. 29 in the 9th Judicial Circuit of Florida - Orange County against KTY Entertainment LLC, doing business as Vain Nightclub, and Downtown Property Group Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 31, 2012, she was at the Vain Nightclub in Orlando to celebrate the New Year. She alleges that as she was traversing the staircase in the overcrowded subject venue, she was pushed over the handrail and fell from the top of the staircase down to the ground floor below, suffering severe and disabling injuries, including a broken neck.

The plaintiff holds KTY Entertainment LLC, doing business as Vain Nightclub, and Downtown Property Group Inc. responsible because the defendants allegedly failed to keep the nightclub in a reasonably safe condition, failed to warn invitees that the handrail on the staircase was insufficient in height, and failed to operate beneath or at the capacity of persons permitted at the property.

The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, costs, and interest where applicable. She is represented by Benjamin J. Steinberg of Avera & Smith LLP in Gainesville.
