Cruise passenger alleges negligence caused finger to be amputated

MIAMI – An Indiana man alleges his finger was amputated while visiting the Cayman Islands as part of a cruise.

David Orth filed a complaint on Jan. 11 in the U.S. District Court for the Southern District of Florida, Miami Division against MSC Cruises, S.A., formerly known as MSC Crociere S.A., alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 28, 2016, he sustained serious physical injuries, including the amputation of a finger, when it got caught between the tender's window stanchion and the cruise ship’s platform. The plaintiff holds MSC Cruises S.A. responsible because the defendant allegedly failed to provide assistance to their passengers using the tender and operated the boat in unsafe conditions.

The plaintiff requests a trial by jury and seeks economic damages, medical expenses, all legal fees and any other relief as this court deems just. He is represented by Robert L. Gardana of Robert L. Gardana PA in Miami.
