Roof-A-Cide files suit over alleged unlawful use of trademark

FORT LAUDERDALE – A Broward County man alleges a mark he uses in association with his business is being unlawfully used.

Roof-A-Cide U.S. Inc. and Frank Miele filed a complaint on Jan. 12 in the U.S. District Court for the Southern District of Florida against Barbara Micali, also known as Barbara Green; Joseph Micali; and Ret Associates Inc., also known as Ret Inc. and doing business as Roof Aide, alleging trademark infringement and other counts.

According to the complaint, the plaintiffs allege that they are the owner of the trademark Roof-A-Cide. The plaintiffs hold the defendants responsible because the defendants allegedly sell a product known as Roof Aide and claim it is the chemical equivalent of the plaintiff's Roof-A-Cide, which the plaintiffs allege misleads consumers. The plaintiffs also allege the defendants breached a prior settlement agreement.

The plaintiffs seek damages, interest and all legal fees. They are represented by James Beagle of James Beagle PA in Fort Lauderdale.
