Consumer files suit over alleged frequent collection calls from Portfolio Recovery Associates

FORT LAUDERDALE – A consumer alleges his privacy was violated by the actions of debt collectors.

Herode Benjamin filed a complaint on Jan. 9 in the U.S. District Court for the Southern District of Florida against Portfolio Recovery Associates Inc. and Bank of America NA citing the Telephone Consumer Protection Act, the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that in 2015, he suffered damages from receiving several collection calls using an automatic telephone dialing system from the defendants in an attempt to collect an alleged debt. The plaintiff holds Portfolio Recovery Associates Inc. and Bank of America NA responsible because the defendants allegedly called the plaintiff several times per day causing embarrassment and humiliation to the plaintiff and for invading his privacy.

The plaintiff requests a trial by jury and seeks statutory damages of $1,500 for each and every violation, enjoin the defendants, and any other relief as the court deems just. He is represented by George N. Andrews of Loan Lawyers LLC in Fort Lauderdale.
