Man alleges he was terminated in retaliation by Florida Cremation Services

MIAMI – A Miami-Dade County man alleges his former Opalocka employer terminated him for complaining about not being paid overtime.

Alex Pabon filed a complaint on Jan. 6 in the U.S. District Court for the Southern District of Florida against Florida Cremation Services LLC and Plutarco E. Valles and Yoleida Valles citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he suffered damages from working more than 40 hours per week without being paid any overtime compensation. The plaintiff holds Florida Cremation Services LLC and Plutarco E. Valles and Yoleida Valles responsible because the defendants allegedly terminated him on Dec. 27, 2016, in retaliation for his complaints about not being paid for all of the hours he worked.

The plaintiff requests a trial by jury and seeks payment of past and future wages, other damages, liquidated damages, all legal fees plus interest and any other relief as the court deems just. He is represented by Rose H. Robbins of Law Office of Rose H. Robbins J.D. in Boca Raton.
