Man files suit against UnitedHealthcare Insurance Co. after paying for medical expenses

MIAMI – A Miami Beach man alleges his insurer underpaid his medical benefits.

Allan I. Jacob, MD filed a complaint on Jan. 5 in the U.S. District Court for the Southern District of Florida against UnitedHealthcare Insurance Co. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that, he suffered damages from paying part of his medical expenses for a surgery. The plaintiff holds UnitedHealthcare Insurance Co. responsible because the defendant allegedly breached its contractual obligation to the plaintiff by underpaying his medical expenses.

The plaintiff requests a trial by jury and seeks recalculation and the issue unpaid benefits to the him, enjoin the defendant, damages, all legal fees and any other relief as the court deems just. He is represented by Isaac J. Mitrani of Mitrani, Rynor, Adamsky & Toland P.A. in Miami Beach.
