Photographer alleges individual unlawfully used copyrighted photo on business website

MIAMI – A Sarasota photographer alleges his photo was used on a business website without authorization.

Joe Myeress filed a complaint on Jan. 5 in the U.S. District Court for the Southern District of Florida against Lorena Osella, doing business as Osella Realty, alleging copyright infringement.

According to the complaint, the plaintiff alleges that he suffered damages from having his copyrighted image used without permission. The plaintiff holds Osella responsible because the defendant allegedly used the plaintiff's image on her business website for promotional purposes.

The plaintiff requests a trial by jury and seeks statutory damages of up to $150,000 for each infringement, all legal fees and any other relief as the court deems just. He is represented by Melissa A. Higbee of Higbee & Associates in Santa Ana, California.
