Capital One Financial alleged to have called man 100 times after he revoked consent

TAMPA – A New Port Richey man alleges he has been contacted by a debt collector 100 times since he asked the calls to stop.

John Vitorino filed a complaint on Jan. 3 in the Tampa Division for the Middle District of Florida against Capital One Financial Corp. alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that in July 2016 he informed the defendant to stop calling him to collect an alleged debt. The plaintiff holds Capital One Financial Corp. responsible because the defendant allegedly kept on calling the plaintiff using an automatic telephone dialing system even after the plaintiff verbally revoked any consent of receiving those calls.

The plaintiff requests a trial by jury and seeks statutory damages, punitive damages, actual damages, all legal fees plus interest, and any other relief as the court deems just. He is represented by Stefan A. Alvarez and William Peerce Howard of The Consumer Protection Firm PLLC in Tampa.
