Comenity Bank alleged to have called woman hundreds of times

OCALA – A woman alleges she has been harassed by a debt collector because of its frequent calls.

Tonja Greene filed a complaint on Jan. 3 in the U.S. District Court for the Middle District of Florida, Ocala Division against Comenity LLC, doing business as Comenity Bank, alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that since she revoked her consent to receive calls from the defendant in July 2016, it has called her 500 times. The plaintiff holds Comenity LLC responsible because the defendant allegedly harassed the plaintiff by placing several phone calls on her cellular telephone despite her request to stop calling and purportedly did so using an automatic dialing system.

The plaintiff requests a trial by jury and seeks statutory damages, punitive damages, actual damages, interest, all legal fees and any other relief as this court deems just. She is represented by Amanda J. Allen of The Consumer Protection Firm, PLLC in Tampa.
