Woman seeks disability benefits from Life Insurance Co. of North America

PENSACOLA – An Escambia County woman claims her claim for disability benefits was denied even though she is still disabled according to the terms of the plan.

Jannette D. Kleeman filed a complaint on Dec. 22 in the U.S. District Court for the Northern District of Florida, Pensacola Division against Life Insurance Co. of North America,  alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in December 2015, she became disabled due to a foot injury, cholecystectomy, and other conditions and was initially approved to receive disability benefits until her claim was terminated on June 2016. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly upheld its decision to terminate plaintiff's disability benefits despite her being disabled according to the terms of the plan.

The plaintiff seeks all plan benefits, interest, all legal fees and any other relief as the court deems just. She is represented by Nick A. Ortiz of Ortiz Law Firm in Pensacola.
