MIAMI – Two Miami-Dade County individuals allege they worked an estimated 26 hours of overtime per week and were not properly compensated for that work by
their former Hialeah employer.
Amilkar Santana and Orlando Santana filed a complaint on Dec. 30 in the U.S. District Court for the Southern District of Florida, Miami Division against
Mytech Roofing Inc. and Sergio Garcia
citing the Fair Labor Standards Act.
According to the complaint, the plaintiffs allege that they worked for more than 40 hours per week without being paid any overtime compensation. The plaintiffs hold Florida Mytech Roofing Inc. and Garcia responsible because the defendants allegedly failed to pay the plaintiff any overtime premiums at a rate of time-and-one-half for working more than 40 hours per week.
The plaintiffs request a trial by jury and seek payment of all overtime wages, liquidated damages, all legal fees and any other relief as the court deems just. They are represented by Robert W. Brock II of Law Office of Lowell J. Kuvin in Miami.
