Navient Solutions accused of violating laws regarding phone use

TAMPA — A man is suing Navient Solutions Inc., a debt collector, alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

Mateus Nogueira filed a complaint on Dec. 28 in the Florida Sixth Judicial Circuit Court against Navient Solutions Inc., alleging that the debt collector called the plaintiff several times in an attempt to collect an alleged debt.

According to the complaint, the plaintiff alleges that since October, he suffered damages from receiving several collection calls. The plaintiff holds Navient Solutions Inc. responsible because the defendant allegedly kept on calling the plaintiff despite his request to stop calling him on his cellular telephone and also used an automatic dialing system.

The plaintiff requests a trial by jury and seeks $500 in statutory damages for each violation, $1,500 in treble statutory damages, all legal fees and any other relief as this court deems just. He is represented by Christie D. Arkovich and Barbara C. Leon of Christie D. Arkovich, P.A. in Tampa.
