Gucci alleges online sellers are marketing counterfeit goods

FORT LAUDERDALE – Gucci claims its trademarks are being used to sell counterfeit goods by several online retailers.

Gucci America Inc. filed a complaint on Dec. 27 in the U.S. District Court for the Southern District of Florida against guccihandbagsoutlet.us, 5seenland-tv.de, afsdc.co.uk, et al., alleging trademark infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business and reputation as the result of lesser quality products that bear its mark being sold to consumers. The plaintiff holds guccihandbagsoutlet.us, 5seenland-tv.de, afsdc.co.uk, et al., responsible because the defendants allegedly use online websites to offer for sale and distribute confusingly similar imitations of plaintiff's trademark.

The plaintiff seeks to enjoin the defendants from further infringing plaintiff's trademark, place the defendants' domains on hold status, transfer all domain names used by the defendants to the plaintiff's control, all profits and damages, statutory damages of $2 million per each counterfeit trademark used, $100,000 per cybersquatted domain name, all legal fees and interest and any other relief as the court deems just.
