Tomahawk Glass Inc. alleged to owe contributions to labor groups

FORT LAUDERDALE – A Largo employer is alleged to have not paid fringe benefit contributions for almost a year.

The trustees of the IUPAT District Council 78 Health and Welfare Fund, the Florida Finishing Trades Institute; and the District Council 78 Political Action Committee filed a complaint on Dec. 27 in the U.S. District Court for the Southern District of Florida against Tomahawk Glass Inc. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid contributions. The plaintiffs hold Tomahawk Glass Inc. responsible because the defendant allegedly breached its agreement with the plaintiff by failing to make full payment of all fringe benefit contributions for payroll periods after Feb. 29, 2016.

The plaintiffs seek damages for all unpaid fringe benefit contributions and other payments, all liquidated damages, all legal fees and any other relief as this court deems just. They are represented by D. Marcus Braswell Jr. of Sugarman & Susskind PA in Coral Gables.
