Work Tools International Inc. claims paintbrush does not infringe Ohio company's patent

TAMPA – A Largo paintbrush manufacturer alleges it has not infringed an Ohio company's patent.

Work Tools International Inc. filed a complaint on Dec. 16 in the Tampa Division for the Middle District of Florida against The Wooster Brush Co. seeking declaratory judgment.

According to the complaint, the plaintiff alleges that on Dec. 9, 2016, it received a letter from the defendant’s attorneys threatening patent infringement litigation if it refused to cease and desist selling an accused product, a paintbrush that the defendant alleged has infringed on its '474 patent. The plaintiff alleges it has been injured by the false accusation of patent infringement and has no means to stop the false accusation of patent infringement by defendant absent declaratory relief from the court.

The plaintiff requests a trial by jury and seeks declaratory judgment that the accused product does not infringe the ‘474 patent, attorneys' fees, costs of action, and other relief to which it may be entitled.
