Man alleges Cheyenne Holdings did not pay him for a period, retaliated against him

FORT MYERS – A man alleges his employer retaliated against him by filing a lawsuit after he complained that he was not paid for two months.

Philip Wildstein filed a complaint in the U.S. District Court for the Middle District of Florida against Cheyenne Holdings Inc., also known as Galaxy Distribution Inc., alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he was hired by the defendant as an independent contractor in October 2014 and was not paid for work for January and February 2015. He alleges he sent the defendant, through his lawyer, pre-suit communications in August 2015 about its failure to pay his wages. The plaintiff holds Cheyenne Holdings Inc. responsible because the defendant allegedly filed a lawsuit in retaliation against the plaintiff in New Jersey for complaining about not being paid proper wages.

The plaintiff requests a trial by jury and seeks damages, all legal fees and any other relief as the court deems just. He is represented by Chad E. Levy of Law Offices of Levy & Levy PA in Fort Lauderdale.
