Former cook claims Brass Monkey Sports Bar and Restaurant did not pay overtime

WEST PALM BEACH – A Palm Beach County man alleges a Lake Worth establishment did not pay him for the overtime hours he worked as a cook.

Victor Montanez filed a complaint on behalf of other similarly situated individuals on Dec. 19 in the U.S. District Court for the Southern District of Florida, West Palm Beach Division against Lee Disbury and Martin F. Servidio, doing business as Brass Monkey Tavern and also known as Brass Monkey Sports Bar and Restaurant, and Martin F. Servidio citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week without being paid any overtime compensation from May to August 2016. The plaintiff holds Disbury and Servidio, doing business as Brass Monkey Tavern and also known as Brass Monkey Sports Bar and Restaurant, and Servidio responsible because the defendants allegedly failed to pay the plaintiff any overtime premium for working more than 40 hours per week, failed to pay a minimum wage and failed to keep accurate time records.

The plaintiff requests a trial by jury and seeks actual damages, unpaid minimum wages plus interest, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by Zandro E. Palma of Zandro E. Palma, P.A. in Miami.
