Pita Plus Inc. employee alleges she was terminated for complaining about unpaid overtime

MIAMI – A Miami-Dade County restaurant is alleged to have not paid overtime wages.

Rachel Atary filed a complaint on behalf of other similarly-situated individuals on Dec. 19 in the U.S. District Court for the Southern District of Florida, Miami Division against the Pita Plus Inc. and Yigal Cohen citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she worked for more than 40 hours per week without being paid any overtime compensation from 2006 to 2016. The plaintiff holds Pita Plus Inc. and Cohen responsible because the defendants allegedly failed to pay the plaintiff any overtime premium for working more than 40 hours per week, did not keep proper records and provided pay stubs with incomplete information. She also alleges she was terminated for complaining about not receiving overtime.

The plaintiff requests a trial by jury and seeks compensatory damages, liquidated damages, back pay and benefits wrongly denied, all legal fees and any other relief as the court deems just. She is represented by Zandro E. Palma of Zandro E. Palma P.A. in Miami.
