Creative Emarketing Inc. accused of charging clients for work that wasn't done

Contract 03

MIAMI – A North Carolina claims a Coconut Creek company breached their contract and charged clients for work it didn't perform.

Doan Solutions LLC filed a complaint on Dec. 7 in the U.S. District Court for the Southern District of Florida against Creative Emarketing Inc., doing business as Student Loan Help 1, alleging breach of contract.

According to the complaint, the plaintiff alleges that it entered into an agreement with the defendant for the defendant to place plaintiff's qualified candidates into a student loan consolidation program. The plaintiff holds Creative Emarketing Inc. responsible because the defendant allegedly failed to pay the plaintiff for clients it provided to the defendant and continued to demand payment via email from the plaintiff's clients, falsely representing that the emails were from the plaintiff. The plaintiff also alleges that the defendant continued to process payments from the clients without performing work on the clients' files.

The plaintiff requests a trial by jury and seeks award damages to the plaintiff, all legal fees and any other relief as the court deems just. It is represented by Joseph D. Garrity, C.C. Traina and Joshua W. Rosenberg of Garrity Traina PLLC in Coconut Creek.
