Woman claims Citibank harassed her over alleged debt owed by husband

ORLANDO – An Orange County woman claims a financial institution has harassed her with calls for debt allegedly owed by her husband.

Gail Kelemen filed a complaint on Nov. 30 in the U.S. District Court for the Middle District of Florida, Orlando Division against Citibank National Association alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff claims that in June 2016, she was contacted by the defendant in an attempt to collect a debt allegedly owed by her husband at least 100 times. She alleges the defendant continued calling her on a daily basis despite her demands to cease calling her, which caused her to suffer the injury of invasion of privacy and the intrusion upon her right of seclusion.

The plaintiff holds Citibank, National Association responsible because the defendant allegedly called plaintiff with such frequency meant to abuse or harass, contacted plaintiff without prior express consent and unlawfully utilized an automatic dialer and automated voice.

The plaintiff requests a trial by jury and seeks judgment against defendant, statutory, punitive and actual damages, costs, interest, attorney's fees, enjoinder from further violations and other relief as the court may deem just. She is represented by Octavio Gomez of Morgan & Morgan in Tampa.
