Employee accuses Miami exterminator of failing to pay overtime

MIAMI — A Miami-Dade County man is suing a Miami extermination business, alleging unpaid wages and violation of workers compensation acts in not paying proper overtime.

Warren Davis filed a class action complaint, individually and on behalf of others similarly situated, Dec. 1 in U.S. District Court for the Southern District of Florida against Al-Flex Exterminators Inc., and Alexander E. Napoles, alleging violation of the Fair Labor Standards Act. 

According to the complaint, Davis worked more than 40 hours per week between July 5-Oct. 31 without being paid any overtime compensation. The plaintiff alleges the defendants failed to pay any overtime premium for working more than 40 hours per week as required by FLSA.

Davis seeks trial by jury, unpaid overtime wages, enjoining the defendant, monetary damages, liquidated damages, interest, all legal fees and all other relief the court deems just. He is represented by attorney Russell S. Moriarty of Levine & Blit, PLLC in Miami.
