Arizona consumer alleges telemarketer violated phone harassment law

MIAMI  — An Arizona man is suing a telemarketer, alleging violation of telephone harassment statutes.

Fred Heidarpour of Maricopa County and Abante Rooter Inc. filed a lawsuit Dec. 1 in U.S. District Court for the Southern District of Florida against Rapid Capital Funding, LLC, alleging the defendant called called the plaintiff's cellular phone several times without consent.

According to the complaint, in March, Heidarpour suffered monetary damages from being called several times on his cellular telephone by Rapid Capital Funding despite his request for the defendant to stop calling him. The plaintiff alleges Rapid Capital used an automatic telephone dialing system to call plaintiff's cellular telephone, in violation of the law.

Heidarpour seeks trial by jury, statutory damages, injunctive relief, all legal fees and any other relief the court deems just. He is represented by attorney W. John Gadd of Clearwater.
