Brevard County man alleges Prudential wrongfully terminated his disability payments

ORLANDO — An employee is suing The Prudential Insurance Company of America, an insurance firm, citing alleged breach of contract.

James D. Nestor filed a complaint on Nov. 25, in the U.S. District Court for the Middle District of Florida Orlando Division against The Prudential Insurance Company of America alleging that the insurance firm denied plaintiff's claim for disability benefits.

According to the complaint, the plaintiff alleges that, in 2014, he became disabled and was initially being paid disability benefits until payments were terminated. The plaintiff holds The Prudential Insurance Company of America responsible because the defendant allegedly upheld their decision to deny further payments to the plaintiff for disability benefits despite being disabled according to the terms of the plan.

The plaintiff seeks judgment against the defendant for all plan benefits, interest and all legal fees. He is represented by Nick A. Ortiz of Ortiz Law Firm in Pensacola.
