Consumer alleges Roundpoint Mortgage Servicing Corp. violated debt collection laws

MIAMI – A Broward County woman alleges a debt collector engaged in deceptive and unfair business practices.

Rachel Landau filed a complaint on Nov. 27 in the U.S. District Court for the Southern District of Florida against Roundpoint Mortgage Servicing Corp. citing the Real Estate Settlement Procedures Act and the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in 2014, a foreclosure action was filed on her home and she was approved for a loss mitigation program in 2016. The plaintiff holds Roundpoint Mortgage Servicing Corp. responsible because the defendant allegedly motioned a foreclosure court to issue an order of sale on the plaintiff's property when she was approved for a loan modification plan.

The plaintiff requests a trial by jury and seeks statutory damages, all legal fees and any other relief as the court deems just. She is represented by Michael A. Citron and Matthew Yerachmiel David Bavaro of Loan Lawyers LLC in Fort Lauderdale.
