Wells Fargo Home Mortgage accused of violating telephone statute

ORLANDO — A consumer is suing Wells Fargo Home Mortgage, citing alleged violations of the Telephone Consumer Protection Act.

Reginald Crawford filed a complaint on Nov. 21 in the U.S. District Court for the Middle District of Florida Orlando Division against Wells Fargo Home Mortgage, alleging that the creditor violated TCPA through intrusive and unwanted calls.

According to the complaint, the plaintiff alleges that in September 2015, he revoked any consent to be called by the defendant, but says he received about 60 unwanted calls on his cell phone after the revocation and claims the defendant used an auto-dialer. The plaintiff holds Wells Fargo Home Mortgage responsible because the defendant allegedly called him with a frequency meant to abuse or harass, contacted him without express consent and invaded his rights to privacy and seclusion.

The plaintiff requests a trial by jury and seeks judgment against the defendant, statutory, punitive, actual and treble damages, a ruling enjoining the defendant from further violations, costs, interest, attorney's fees and other relief the court may deem just. He is represented by Amy Ferrera of Morgan & Morgan PA in Tampa.
