Fresenius Medical Care Holdings, Bio-Medical Applications of Florida accused of breaching duty

MIAMI — A woman is suing Fresenius Medical Care Holdings Inc. and Bio-Medical Applications of Florida Inc., citing alleged breach of fiduciary duty.

Kemaley Dennie filed a complaint on Nov. 23 in the U.S. District Court for the Southern District of Florida against the defendants, alleging that they denied her claim for medical coverage.

According to the complaint, the plaintiff alleges that she underwent surgery and other medical procedure but her coverage was denied. The plaintiff holds the defendants responsible because they allegedly initially approved her medical coverage but later rescinded the decision, causing monetary damages to the plaintiff.

The plaintiff seeks reimbursement of medical expenses, interest, statutory penalties, all legal fees and any other relief as this court deems just. She is represented by Keith M. Stern of Law Office of Keith M. Stern, P.A. in Miami.
